Frederick County Grand Jury Issues Six Indictments

One was against a suspect connected with a shooting in downtown Frederick.

Frederick, Md (KM) Six indictments were returned on Friday by the Frederick County Grand Jury. One was against  Darryl Lee Cooke, 29, of Frederick, who is charged with 2nd-degree murder; two counts of 1st-degree assault; three counts of use of a firearm with a felony conviction; having a loaded handgun on his person; possession of a firearm with a prior conviction for a crime of violence; and illegal possession of ammunition.. .

Frederick Police say on Saturday, October 5th, 2024, , at around  1:50 AM, officers on patrol in the area of East Church and South Market Streets heard gunfire. They found two victims at the intersection with gunshot wounds. Both were taken to area hospitals. The State’s Attorney’s Office says one of those victims died recently, and that’s why Cooke is charged with 2nd-degree murder. Cooke was nearby, and police took him into custody. He is currently being held without bond.

Other indictments handed down by the Grand Jury on Friday:

*Rahmere Khaheeb Isiah Smith 25, of Brookhaven, Pa., who is charged possession with intent to distribute cocaine; a motor vehicle charge of failing to stop  at a stop sign; another motor vehicle charge of failing to stop at a red signal; and a third motor vehicle charge of two counts of eluding police by fleeing on foot for an offense which occurred on September 29th, 3034.

*Donald Bernard Brooks, 66, of Frederick, Md, who is charged with two counts of 3rd degree sex offense for offenses which occurred from September 18th, 1978 to September `17th, 1979; and September 18th, 1979 through September 17th, 1980.

*Jason Waddy, 48, of Rocky Ridge, Md. who is charged with five counts of depicting a sex act in a child pornography film; five counts of 3rd degree sex offense; 4th degree sex offense involving contact; and 14 counts of possession of child pornography for offenses which occurred between December 28th,  2021 to August  3, 2024.

*Wesley  James Judson Fox, 31, of Frederick, Md.  who is charged with 1st-degree assault; 2nd-degree assault; and reckless endangerment for  an offense which occurred  on October 6th, 2024.

*Jon Clayton Moles, 29, of Frederick, Md, who is charged with  1st degree assault and 2nd-degree assault for an offense  which occurred on September 27th, 2024.

These indictments move these cases to the  Circuit Court where trail dates will be scheduled.

The Frederick County State’s Attorney’s Office says an indictment is a charging document alleging criminal conduct, and all defendants are innocent until proven guilty.
