Frederick, Md (KM) Sentencing was handed down on Tuesday to a Frederick man who attacked his parents with a baseball bat. Salvador Antonio Javitt, 21, received 30-years for attempted 2nd-degree murder, with all but six years suspended. For 1st-degree assault, Javitt was given 20 years with all but five years suspended. That all totals out to 11 years.

Javitt had pleaded guilty to those two charges on April 9th, 2021.

Chief Assistant State’s Attorney Rebecca Clinton, who heads up the Violent Crimes Unit for the Frederick County State’s Attorney’s Office, says Javitt’s parents were in court on Tuesday, and asked for leniency for their son. “There were a lot of family dynamics that were going on. They didn’t want their son to be prosecuted,” she said. “But certainly given the extent of the injuries,   the scope of it, it was very serious offenses.”

In October, 2019, Clinton says Javitt got into an argument with his parents at their home Overton Circle. “One of his parents was asking him about social media. And he then did strike both of his parents with the bat, and strangled his mother. So it was a very horrific crime scene,” she says.

Both parents were taken to University of Maryland Shock Trauma in Baltimore with life-threatening injuries. They have since recovered.

The State’s Attorney’s Office had recommended 18 years active incarceration’  and that Javitt be sent to the Patuxent Institution, a treatment-oriented maximum security correctional center. But Judge Willian Nicklas decided on 11 years, but said the Court recommended the defendant be incarcerated at the Patuxent Institution.  Javit will also be put on five years of supervised release after he’s  finished his sentence.

“It’s always difficult when you feel differently about punishment than the victims,” says State’s Attorney Charlie Smith, in a statement. “In the end, I think the judge balanced his position against ours  and came to this sentence.”
